Mindy Sheps is a senior partner in the firm and is a member of the Real Estate Practice Group, with over 25 years of diverse experience in the area of transactional real estate, advising clients in all aspects of real estate matters, including property acquisitions and dispositions, financing, leasing, construction, land use and private land use arrangements.

Areas of Practice
Real Estate Acquisition and Disposition

  • Representation of clients in complex commercial real estate sales and acquisitions, including unimproved land, ground leases, multi-family projects and office buildings, as well as the purchase and sale of individual residential properties

Leasing

  • Counseling both landlords and tenants of office and retail space. Leasing practice encompasses work on behalf of landlords and tenants of office, medical, retail and industrial properties

Construction

  • Representation of both contractors and owners. Experience in all aspects of contract documentation for the design and construction of private schools, office buildings and retail facilities as well as construction of single family homes and remodels. Extensive experience with tenant build-outs from both landlord and tenant perspectives
  • Representation of homeowner associations on both large and small repair and renovation projects, including, remodels, upgrades and earthquake repairs

Financing

  • Counseling clients in real estate finance transactions, including acquisition, construction financing, sale leaseback and defeasance transactions

Land Use and Environmental Issues

  • Expertise in land use approvals and the development process, from conducting pre-acquisition due diligence to obtaining final certificates of occupancy. Experience with Coastal Act entitlement process
  • Representation of homeowner associations opposing undesirable development, advocating at planning and city council hearings and crafting agreements with developers to minimize impacts on adjacent owners and homeowner associations

Title and Land and Access Disputes

  • Expertise in resolving title issues, prescriptive rights, adverse possession and boundary line disputes. Extensive experience with drafting easements, licenses and settlement agreements of all kinds related to real property issues
